D.C. teacher pleads guilty to touching student

WASHINGTON — A Northwest D.C. fourth-grade teacher pleaded guilty to inappropriately touching an 11-year-old boy.

Wearing an orange prison jumpsuit, Giovanni Peña, 31, of D.C. appeared Friday in a D.C. Superior Courtroom to agree to a plea deal.

As part of the plea deal, Peña admitted he inappropriately touched the 4th grade student inside his Oyster Adams Elementary School classroom in August 2013 and June 2014.  He also admitted to sending the student sexually explicit photos through the smartphone app Snapchat.

Peña pleaded guilty to one felony count of second-degree child sex abuse and one misdemeanor count of obscenity.  The felony could put Pena behind bars for up to 10 years.  He could face up to 180 days in jail for the misdemeanor.

Also as part of the plea agreement, the prosecution will not seek any additional charges that predate the agreement.

The defense asked for Peña to be released until sentencing, however the judge turned down that request.

Peña will be sentenced Sept. 4.
