FINCASTLE, Va. (AP) _ A group of residents has filed a lawsuit challenging Botetourt County’s wind farm ordinance.
The lawsuit says the ordinance fails to protect the public from dangers posed by industrial wind turbines. According to the lawsuit, these dangers include catching fire and emitting audible and low frequency noise.
The lawsuit asks a judge to invalidate the ordinance.
The Roanoke Times (http://bit.ly/1I13NCZ ) reports that eight residents filed the lawsuit last week in Botetourt County Circuit Court.
County attorney Michael Lockaby says the lawsuit’s allegations are false.
The Botetourt County Board of Supervisors approved the ordinance in June. The ordinance allows turbines up to 550 feet tall.
Charlottesville-based Apex Clean Energy plans to build up to 25 wind turbines on a ridgeline north of Eagle Rock. The company hasn’t yet applied for permits.
