Court affirms Appian win in trade-secrets case, but battle with Pegasystems is far from over

The Circuit Court for Fairfax County has rejected a bid by software developer Pegasystems Inc. to throw out the jury’s verdict in awarding $2.04 billion to Tysons-based rival Appian Corp. (NASDAQ: APPN) in a trade-secrets case and ordered Pegasystems to pay an additional $23.6 million in attorney’s fees and interest on the judgment that could add another $122 million a year to the total.

The long-running legal drama is far from over, however, as Pegasystems last week filed an appeal, potentially dragging the case out for years. Pegasystems will not be required to pay any damages until the appeals process plays outs.

The ruling on Friday marked the second time that the court has rejected an effort by Cambridge, Massachusetts-based Pegasystems (NASDAQ: PEGA) to toss out the jury’s May 9 verdict, which came after a 7-week trial and is believed to be the largest award in Virginia history.
