LEESBURG, Va. — The driver of the Jeep Cherokee who allegedly struck and killed a 5-month-old boy being pushed in a stroller by his mother in Lansdowne has been released on bond, before his trial for involuntary manslaughter.
John Miller IV, of Leesburg, stood quietly beside his lawyer, in Loudoun County Circuit Court, one day after he was indicted on the felony charge, as well a misdemeanor reckless driving and failure to yield to pedestrians in a crosswalk.
After being released, Miller had no comments to reporters. His lawyer Steven Webster said his comments would come solely in court.
Prosecutors have not commented on the case against Miller, 45.
Search warrants filed before the indictment said a driver following Miller on Coton Manor Drive the morning of Aug. 31 saw him holding a phone in his left hand, as if he were watching or reading something.
An affidavit in the case said a voicemail was deleted from Miller’s Samsung phone, at approximately the time of the crash.
The boy’s mother Mindy Schulz was seriously injured but released from the hospital in the days after her son was killed.
During the brief court appearance, defense lawyer Webster told judge Judge Douglas Fleming, Jr. he believed “discovery will be substantial,” and asked to set a hearing in the coming weeks so he could learn more about the prosecution’s evidence against client.
The judge set a $10,000 personal recognizance bond.
Miller’s next court date is Dec. 5.
