ALEXANDRIA, Va. – An alleged drunken driver has been indicted on a charge of aggravated involuntary manslaughter and three other counts for allegedly hitting and killing an 8-year-old boy and severely injuring his mother while the two were walking near Landmark Mall.
Prosecutors with the Alexandria Commonwealth’s Attorney’s Office have said Victor Aldana, of Alexandria, had been drinking for five hours before the January 2012 crash that killed Brian Hernandez-Chavez and caused severe injuries to the boy’s mother.
Commonwealth’s Attorney Randy Sengel tells WTOP that in addition to the manslaughter charge — which carries a maximum penalty of 20 years — Aldana was indicted on a charge of maiming while driving under the influence in connection with Maria Chavez’s injuries. He also was indicted on charges of driving under the influence and driving without an operator’s license.
Chavez suffered a broken pelvis and two broken legs as she and her son walked along a footpath that runs along Duke Street.
Aldana worked at a nearby Kentucky Fried Chicken restaurant at the time of the crash.
A trial date will be set in Alexandria Circuit Court.
