W.Va. city seeks dismissal of police shooting suit

MARTINSBURG, W.Va. (AP) — A West Virginia city and five police officers are seeking the dismissal of a $200 million lawsuit stemming from the fatal shooting of a Virginia man.

The family of 50-year-old Wayne Arnold Jones of Stephens City, Virginia, sued Martinsburg and the officers last year. The federal lawsuit alleges that police used unreasonable and excessive force. It says Jones was shot 15 to 25 times while he was on the ground on March 13, 2013.

The Journal (http://bit.ly/1nZtJlc ) reports that attorneys for the city and the officers asked a judge earlier this month to dismiss the lawsuit. Their motion says Jones represented a lethal threat.

Police have said Jones drew a knife after the officers stopped him as he was walking on a street. One officer was stabbed during a scuffle.
