    You have your Constitution wrong
    In Article 1, Section 5 of the Constitution, it states: "Each House may determinethe Rulesof its Proceedings, punish its members, and, with the Concurrence of two thirds, expel a member." So the fact that the Senate has chosen in its rules, explicitly allowed under the Constitution, to allow a filibuster requiring sixty votes to break is, however distasteful anyone may find it, absolutely according to the constitution.
    What is more, if you read up on the events surrounding its framing, find that the constitutional convention was always concerned that a "Tryanny of the majority" could break apart the country. In an issuelike this, which is so tightly bound with fundamental freedom, and bordering (or as some view, already exceeding) the constitution without ammending it, this is the right place to keep us together.
