RICHMOND, Va. (AP) — A stripped down $40 million lawsuit naming Virginia Alcoholic Beverage Control agents is moving ahead.
A federal judge in Richmond on Tuesday dismissed all or parts of nine of the 12 counts in the lawsuit, filed by a University of Virginia student. The student fled in terror when her vehicle was swarmed by state ABC agents last summer in Charlottesville.
They believed the underage student had purchased beer when in fact it was sparkling water.
The Richmond Times-Dispatch (http://bit.ly/1uBzQjG) reports that U.S. District Judge Henry E. Hudson declined the state’s motion to dismiss charges of false arrest, common law malicious prosecution and assault charges involving three of the agents.
He is seeking more filings from student Elizabeth K. Daly’s attorneys.
