WASHINGTON - The Virginia Supreme Court has agreed to hear two cases that could decide if the transportation bill passed last year is constitutional.
The Loudoun County Board of Supervisors and a group of citizens, including Delegate Bob Marshall, (R-Manassas), filed challenges to the state law.
The bill allows the Northern Virginia Transportation Authority to impose taxes to specifically fix roads in this region. Del. Marshall and the Loudoun Board of Supervisors claim that the Authority has no right to raise money since members of the Authority were not elected. They are focusing on the entire bill, not just one section which includes the controversial driver abuse fees.
An Arlington County Circuit judge ruled against their claim last July.
The Supreme Court hearing on the appeal is scheduled for the second week in January.
