Judge may dismiss workplace threat case

UPPER MARLBORO, Md. (AP) -- A judge is signaling that she will likely dismiss a case against a Maryland man accused of calling himself a "joker" and threatening to shoot his supervisor.

Prince George's County District Court Judge Patrice Lewis said Tuesday that she is inclined to agree with a defense lawyer's argument that the court documents charging Neil Prescott are "defective" and unfairly vague in describing the allegations. She says she is tempted to throw out the case.

The judge gave prosecutors a chance to talk it over before announcing a formal ruling.

Prescott was charged last year with misusing a telephone, a misdemeanor, after police said he told a coworker that he would shoot his boss. Prescott's lawyer said he would show that the coworker thought Prescott was joking.
