Portsmouth officer found not guilty of cruelty

SUFFOLK, Va. (AP) -- A Suffolk judge has found a Portsmouth police officer and his wife not guilty of animal cruelty charges.

The charges against Brian and Jennifer Davis of Suffolk stemmed from the death of a retired police horse.

Susan Walton with the Suffolk Commonwealth's Attorney's Office tells WAVY-TV (http://bit.ly/1aCrq2F ) that the judge's decision came Tuesday following a hearing in Suffolk General District Court.

The couple adopted the horse, named Amy, in 2009 after she was retired from the police department's mounted patrol.

Debra and David Kelly took over caring for the horse in March. They told WAVY that the horse appeared to be emaciated.

The horse died two weeks after the Kellys began caring for her. They say a veterinarian determined that the horse had been starved.
