Ex-Culpeper chief dismissed from lawsuit

CULPEPER, Va. (AP) -- A judge has dismissed former Culpeper Police Chief Dan Boring as a defendant in a lawsuit stemming from the fatal shooting of a woman by a former officer.

But Culpeper County Circuit Court Judge Susan Whitlock rejected the town of Culpeper's motion to dismiss current Police Chief Chris Jenkins as a defendant.

The lawsuit alleged that Boring and Jenkins were negligent in hiring, supervising, training and retaining former police officer Daniel Harmon-Wright.

Harmon-Wright is serving a three-year prison sentence after being convicted in January on manslaughter and unlawful shooting charges. He's also a defendant in the lawsuit.

Harmon-Wright was convicted of fatally shooting 54-year-old Patricia Ann Cook of Culpeper on Feb. 9, 2012. Cook's brother filed the lawsuit.

The Culpeper Star-Exponent ( ) reports that Whitlock issued her decision on Monday.
