Man indicted on capital murder charge

WOODBRIDGE, Va. (AP) -- A man accused of fatally shooting a retired federal agent who was out walking his dog has been indicted on a capital murder charge.

Twenty-five-year-old Aric Smith of Woodbridge could be sentenced to death in the Feb. 20 shooting of 55-year-old Gregory L. Holley Sr., also of Woodbridge.

Commonwealth's Attorney Paul B. Ebert said he has not decided whether to seek the death penalty if Smith is convicted.

The Washington Post reports ( at a hearing Tuesday in Prince William County Circuit Court, Smith's attorneys declined to comment.

Police said Smith killed Holley, who was retired as an Army officer and as a Bureau of Alcohol, Tobacco, Firearms and Explosives agent, during a botched robbery.
