No charges in fatal Va. wreck involving school bus

VIRGINIA BEACH, Va. (AP) -- Virginia Beach's prosecutor says the driver of a school bus that struck and killed a man won't be charged.

Commonwealth's Attorney Harvey Bryant says the Oct. 22 accident was a tragic situation. He says there's no evidence to support reckless driving or involuntary manslaughter charges against the bus driver.

Police say the bus hit 27-year-old Christian R. Montes as he was standing outside his disabled vehicle. The bus driver hasn't been identified.

Bryant announced his office's findings on Monday.

An attorney for Montes' family, Gary C. Byler, tells media outlets that the family is considering filing a lawsuit against the driver and the Virginia Beach school board.
