PULASKI, Va. (AP) -- A wrongful death lawsuit has been filed against a Virginia day-care center where a wooden storage box fell on a 6-year-old boy.
The lawsuit filed in Pulaski County Circuit Court by the family of Darin Conner seeks $3 million from the operators of Busy B's Day Care Center in Dublin.
The center's operators didn't immediately return a telephone message Tuesday.
The lawsuit says the storage box was "essentially unsecured" on top of another box when it fell on the boy May 7.
The Roanoke Times (http://bit.ly/1dQA3IJ) reports a state Department of Social Services investigation found the boy had previously climbing incidents at the center, and that shelving units had been rearranged and moved in front of windows after he made several attempts to climb into the inside window ledges.
