Albemarle supervisor removal petition denied

CHARLOTTESVILLE, Va. (AP) -- An Albemarle County supervisor who pleaded guilty to sexual battery has survived an attempt to remove him from office.

Media outlets report that a judge denied a petition seeking Supervisor Christopher J. Dumler's removal.

Albemarle County Circuit Judge Cheryl Higgins said in her Friday ruling that there weren't any grounds for Dumler's removal under the state law cited by the petition.

Higgins said she understood the petitioners' frustrations. But she said the court was limited to the grounds set forth in the law.

Those grounds are conviction of a misdemeanor hate crime or certain misdemeanor drug offenses, or neglect of duty, misuse of office or incompetence.

Dumler called the petition frivolous and said he's happy with the judge's decision.
