Va adult group home owner convicted

MARTINSVILLE, Va. - The owner of a Martinsville group home for adults has been found guilty of charges stemming from a resident's February 2011 death.

Attorney General Ken Cuccinelli announced Monday that a Martinsville jury convicted The Claye Corp. owner Richard C. Wagoner Jr. of abuse and neglect of an incapacitated adult that resulted in death.

Cuccinelli says the victim, 57-year-old Joseph Tuggle, had been placed in a bathtub with scalding water. An investigation found that Tuggle's caregivers put him in a van to go to a hospital, but Wagoner ordered it returned to the group home. He then examined Tuggle's injuries and decided to keep him at the home instead of seeking emergency treatment.

Tuggle was found dead in his bed 10 days later.

Sentencing is set for Oct. 18.
